In adopting the State Anti-Corruption Program, guarantees of the independence of the judiciary should be provided

On January 19, 2023, at the first meeting in the new plenipotentiary composition, the High Council of Justice decided to support with comments and suggestions the draft resolution of the Cabinet of Ministers of Ukraine “On approval of the State Anti-Corruption Program for 2023-2025”.

The HCJ emphasized that address corruption risks in the judiciary is, without a doubt, a priority task in the activities of not only anti-corruption bodies, but also the judiciary.

At the same time, the HCJ sent to the National Agency on Corruption Prevention and the Cabinet of Ministers of Ukraine critical comments and reservations to certain provisions of the annexes to the SAP (Expected strategic results for implementation of the SAP and Measures for implementation of the SAP. Since many of the already settled issues are positioned in the documents as problematic, there are contradictions with the norms of existing laws, subjective statements take place.

The High Council of Justice once again notes that it is extremely important to maintain a balance between the introduction of anti-corruption mechanisms and the provision of real guarantees for the activities of institutions in which these mechanisms are applied.

Many hours of professional and thorough discussion of the project took place, as a result of which a decision was taken based on European standards and national legislation. The expressed proposals will be the subject of further discussion by the authors of the project and representatives of the VRP. During the meeting, Deputy Chairman of the National Agency for Corruption Prevention Andrii Vyshnevskyi expressed readiness for a constructive dialogue.
