Since the beginning of the year, the High Council of Justice has considered almost 11.5 thousand disciplinary complaints

During January-October 2020, the High Council of Justice received 8,584 complaints about a judge's disciplinary misconduct (for the same period in 2019 - 8106 complaints).

Such data are given in the information and analytical report on the activities of the High Council of Justice and the Disciplinary Chambers of the High Council of Justice for 10 months of 2020.

During this period, the Disciplinary Chambers and members of the HCJ completed the consideration of 11,438 disciplinary complaints, including those received in previous years. In 2019, 12,044 complaints were considered during the same period.

Based on the results of consideration of disciplinary complaints, the Disciplinary Chambers adopted 1569 decisions, of which:

193 decisions to return a disciplinary complaint by decisions of the Disciplinary Chambers (for the same period in 2019 – 113);

818 decisions to refuse to open disciplinary cases or to leave the application without consideration (for the same period in 2019 – 624);

358 decisions to open a disciplinary case (for the same period in 2019 – 223);

103 decisions to bring judges to disciplinary liability (for the same period in 2019 – 125);

97 decisions on refusal to bring judges to disciplinary liability and closure of disciplinary proceedings (for the same period in 2019 – 126).

In total, for the first ten months of 2020, the HCJ Disciplinary Chambers made 103 decisions on bringing to disciplinary liability 114 judges. According to the results of consideration of disciplinary cases, the following types of disciplinary sanctions were applied to judges:

  • warning – regarding 57 judges;
  • reprimand with deprivation of the right to receive additional payments to the salary of a judge within one month – regarding 23 judges;
  • reprimand with deprivation of the right to receive additional payments to the salary of a judge within three months – regarding 20 judges;
  • submission for temporary suspension from administering justice – regarding 4 judges;
  • submission for dismissal – regarding 10 judges.

The grounds for bringing a judge to disciplinary liability are provided by part one of Article 106 of the Law of Ukraine "On the Judiciary and the Status of Judges".

Also members of the High Council of Justice made 5491 individual decisions on leaving disciplinary complaints without consideration (during January-October 2019, were made 6939 of such decisions).
