Six judges were dismissed for resignation

The HCJ decided to dismiss under submission of application for resignation:

On August 8, 2023 -

  • Ihnatenko Polina Yakivna – from the office of judge of the Kherson court of appeal;
  • Riabishyn Andrii Oleksandrovych – from the office of judge of the Poltava court of appeal;
  • Hanchak Larysa Fedorivna from the office of judge of the Svaliavskyi district court of Zakarpattia region.

On August 10, 2023 Danylevych Nadiia Andriivna.

On August 17, 2023 -

  • Kheilo Yana Valeriivna – from the office of judge of the Donetsk court of appeal;
  • Katerynchuk Liliia Yosypivna – from the office of judge of the Supreme Court.

SJA Head was suspended from performing official duties for the period of disciplinary proceedings

On August 8, 2023, the HCJ decided to initiate disciplinary proceedings against Oleksii Salnikov, the Head of the State Judicial Administration of Ukraine at the initiative of the HCJ member and submit it to the Commission on Senior Civil Servants in the Justice System. The HCJ suspended him from the performance of official duties as the Head of the State Judicial Administration of Ukraine from August 8, 2023 for the period of the disciplinary proceedings.

HCJ gave consent to hold in custody and suspend from the administration of justice of Illia Lonskyi, judge of the Prymorskyi district court of Odesa

On August 10, 2023 the HCJ gave its consent to hold in custody Illia Lonskyi,  judge of the Prymorskyi district court of Odesa.

On August 14, 2023 the HCJ partially satisfied petition of the Deputy Prosecutor General – Head of the Specialized Anti-Corruption Prosecutor’s Office Oleksandr Klymenko and temporarily, until September 20, 2023, suspended from the administration of justice in connection with criminal prosecution Illia Lonskyi, judge of the Prymorskyi district court of Odesa.

Judge Illia Lonskyi is suspected of committing a criminal offense under part 3 of Article 15, part 3 of Article 369, part 2 of Article 190 of the Criminal Code of Ukraine, namely, an attempt to provide an improper advantage to another judge for making a positive decision in a case of an administrative offense, as well as taking part of the improper advantage by deceiving a judge of the Prymorskyi district court of Odesa – shall be punishable by imprisonment for a term of four to eight years with forfeiture of property.

HCJ responded to interference: judge was offered part of the awarded funds

The HCJ decided to take measures to ensure the independence of judges and the authority of justice, under notification of the Supreme Court judge Yevhenii Krasnoshchokov.

The judge reported that the plaintiff in the case pending before him made an offer to provide an improper advantage. In the cassation instance, she appealed the actions of the employer, asked to recognize the order as illegal and cancel the order, to collect the average salary for the period of suspension from work.

The HCJ addressed to the Prosecutor General’s Office on providing information regarding disclosure and investigation of a crime in criminal proceedings based on the facts notified by the judge.

HCJ offered its observations on draft laws on strengthening responsibility for corruption in the justice sector

The HCJ approved an advisory opinion on draft laws “On making amendments to the Criminal and Criminal Procedure Codes of Ukraine on strengthening responsibility for corrupt criminal offenses in the justice sector” (No. 9438, No. 9438-1).

The HCJ emphasized the inadmissibility and unacceptability of any manifestations of corruption in all areas and noted its unconditional readiness to take measures for self-cleansing. However, the Council focused on the fact that strengthening criminal responsibility should apply to all spheres, since corruption as a manifestation of a systemic phenomenon requires systemic counteraction.

The HCJ pointed out the need for significant revision of draft laws, taking into account the comments and reservations.
