Starting from 21 February 2024, the availability of e-Cabinet in the Unified Judicial Information and Telecommunication System will be mandatory in civil and administrative proceedings for all private legal entities.
This is provided by the Law of Ukraine the Law of Ukraine “On Amendments to certain legislative acts of Ukraine on the mandatory registration and use of electronic cabinets in the Unified Judicial Information and Telecommunication System or its separate subsystem (Module) ensuring document exchange”, register No. 3200-IX.
On February 19, 2024, the High Council of Justice temporarily, until April 9, 2024, suspended from administration of justice judge of the Bolhradskyi district court of Odesa region due to bringing to criminal responsibility.
HCJ will make to the President of Ukraine submission on appointment of three judges
The High Council of Justice took decision on making submission to the President of Ukraine on appointment of two judges to local courts:
Miroshnichenko Dmytro Yevhenovych – to the position of judge of the Economic Court of Zakarpattia region;
Blashchuk Artem Mykolaiovych – to the position of judge of the Podilskyi district court of Kyiv;
Hutsol Maksym Pavlovych – to the position of judge of the Milivskyi district court of Luhansk region.
HCJ dismissed 10 judges on general grounds
The HCJ has considered materials on dismissal of judges on general grounds.
The Council decided to dismiss 9 judges due to submission of application for resignation, in particular:
Romanets Lolita Anatoliivna – from the office of judge of the High Specialized Court for Civil and Criminal Cases;
Vihovskyi Serhii Ivanovych – from the office of judge of the Skvyrskyi district court of Kyiv region;
Lohviniva Olha Vasylivna – from the office of judge of the Kyivskyi district court of Poltava;
Ivanova Olha Vasylivna – from the office of judge of the Rozdilnianskyi district court of Odesa region;
Vivchar Heorhii Aurelovych – from the office of judge of the Novoselytskyi district court of Chernivtsi region;
Zhukovska Liudmyla Arkadiivna – from the office of judge of the Rivnenskyi circuit administrative court;
Bartosh Nadiia Stanislavivna – from the office of judge of the Second Administrative Court of Appeal;
Tiutiunyk Maryna Serhiivna – from the office of judge of the Zaporizhzhia region;
Maletych Mykhailo Mykhailovych – from the office of judge of the High Economic Court of Ukraine.
The HCJ has also dismissed Malashyna Yuliia Bohdanivna from the office of judge of the Ordzhonikidzevskyi local court of Dnipropetrovsk region in connection with filing an application of her own free will.
The HCJ decided to suspend consideration of two letters of resignation of judges, namely: Kikhtenko Serhii Oleksandrovych – on dismissal from the office of judge of the Bohuslavskyi district court of Kyiv region and Maslo Inna Valentynivna – on dismissal from the office of judge of the High Administrative Court of Ukraine.
On February 22, 2024, the HCJ took decision on transferring of judges of the High Administrative Court of Ukraine to the positions of judges of the Sixth administrative court of appeal, in particular:
Holiashkin Oleh Volodymyrovych;
Cherpak Yurii Kononovych;
Shtulman Ihor Volodymyrovych.
This was stated by the Chairman of the High Council of Justice Hryhorii Usyk in the course of working meeting with experts of the EU project “PRAVO-JUSTICE III”.
At the meeting, participated by the HCJ members, the parties discussed areas of cooperation in the process of European integration, as well as the need to analyze national legislation for compliance with EU law.
Three main areas of cooperation have been identified: translation of judgments of the Court of Justice of the European Union (Luxembourg), the European Court of Human Rights, and EU legal acts and provision of expert commentary on those; conducting trainings/education for the HCJ members and employees of the HCJ Secretariat regarding the implementation/interpretation of judgements of these courts; analysis of Ukrainian legislation in the light of EU legal acts, support for the HCJ and providing other necessary assistance within the framework of the negotiation process under Chapter 23 “Rule of Law and Fundamental Rights and Freedoms”.
