
HCJ decided to make a submission to the President of Ukraine on appointing a judge to the Commercial court of Luhansk region
On January 11, 2022, the HCJ decided to dismiss due to the submission of applications for resignation:
- Savych Yurii Mykolaiovych – from the position of the judge of the Luhansk appellate court;
- Khoroshevskyi Oleksandr Mykolaiovych – from the position of the judge of the Kharkiv appellate court;
- Kupelskyi Anatolii Vadymovych – from the position of the judge of the Khmelnytskyi appellate court.
On January 13, 2022, the HCJ decided to dismiss due to submission of applications for resignation Lohvyniuk Iryna Mykolaivna from the position of the judge of the Kovel city district court of Volyn region.
HCJ seconded three judges to administer justice
The HCJ, on January 11, 2022, decided to second two judges to the Solomianskyi district court of Kyiv to administer justice for a period of one year, namely:
judge of the Borznianskyi district court of Chernihiv region Rikhter Vladyslav Volodymyrovych – from January 24, 2022;
judge of the Kramatorskyi city court of Donetsk region Mytrofanova Alesia Oleksiivna – from February 1, 2022.
Besides, the HCJ decided to second judge of the Slovianskyi city district court of Donetsk region Pronin Serhii Heorhiiovych to the Avdiivskyi city court of Donetsk region for the period of one year from January 20, 2022. As a result, the administration of justice will be restored in a court that has not been operating since 2014.
Since August 5, 2021, the distribution of disciplinary complaints between HCJ members has been terminated
In order to prevent violations of current legislation, the HCJ terminated the distribution of disciplinary complaints between members of the Council. And also complaints regarding decisions on bringing judge or prosecutor to disciplinary liability. On August 5, 2021, the HCJ made the decision on the termination of distribution of certain cases (materials) between HCJ members.
Since entering into force of the Law of Ukraine of July 14, 2021, No. 1635-ІХ “On making amendments to certain legal acts of Ukraine regarding the procedure of election (appointment) to positions of members of the High Council of Justice and the activity of disciplinary inspectors of the High Council of Justice” disciplinary complaints should be distributed to disciplinary inspector of the HCJ. The procedure of appointment to the position of the disciplinary inspector shall be carried out in accordance with requirements, established by the law. As there are currently no disciplinary inspectors, complaints regarding judge's disciplinary misconduct are not distributed. As of January 11, 2022, the HCJ has 3 151 undistributed complaints.
Procedure of secondment a judge to the Dubenskyi city district court of Rivne region has begun
The HCJ, according to the decision of January 11, 2022, No. 27/0/15-22 announces the beginning of the procedure of seconding one judge to the Dubenskyi city district court of Rivne region.
Judges who expressed the wish to be seconded to the mentioned court must submit to the High Council of Justice within ten days (from the date of the announcement of the beginning of the procedure for seconding judges) necessary documents.
Term of granting judges’ consent for secondment to three courts has been extended
The HCJ, according to decisions of January 11, 2022, No. 23/0/15-22, No. 24/0/15-22, No. 29/0/15-22 extended the term for granting judges’ consent for being seconded to the Ananiivskyi district court of Odesa region, Artsyzkyi district court of Odesa region and the Chutivskyi district court of Poltava region.
Judges who expressed the wish to be seconded to mentioned courts must submit till January 20, 2022, (regarding Ananiivskyi district court of Odesa region and the Artsyzkyi district court of Odesa region) and till January 24, 2022, (regarding the Chutivskyi district court of Poltava region) to the High Council of Justice necessary documents.
HCJ responded to notification of judge of the Avtozavodskyi district court of Kremenchuk of Poltava region on interference in her professional activity
The HCJ decided to address the Prosecutor General’s Office on providing information on disclosure and investigation of a crime in criminal proceedings, entered to the URPI by part one of Article 376 of the CC of Ukraine by facts, reported in the notification of judge of the Avtozavodskyi district court of Kremenchuk of Poltava region Oksana Palchyk.
Lawyer of the citizen K., in respect of whom the judge had a case under consideration, informed her client received a photocopy of the judgment through the Telegram messenger, which closed the proceedings due to the absence of an administrative offense in K.'s actions. An unknown person offered to receive the original judgment after transferring to the account a sum of money equivalent to 500 US dollars.
