HCJ will make submissions to the President of Ukraine on appointing three judges to local courts

On January 30, 2025,  the HCJ made a decision on making submissions to the President of Ukraine on appointing two judges to positions in local courts:

  • Malaniuk Oleh Yaroslavovych – to the position of the judge of the Avdiivskyi city court of Donetsk region;
  • Chornyi Ihor Anatoliiovych – to the position of the judge of the Zdolbunivskyi district court of Rivne region.

On February 11, 2025,  the HCJ made a decision on making a submission to the President of Ukraine on appointing Kondratieva Nataliia Anatoliivna to the position of the judge of the Yavorivskyi district court of Lviv region.

Three judges were dismissed on general grounds

On February 4, 2025,  the Council decided to dismiss due to the submission of applications for resignation:

  • Makarenko Iryna Oleksandrivna – from the position of the judge of the Shevchenkivskyi district court of Kyiv;
  • Litvinova Larysa Fedorivna – from the position of the judge of the Mezhivskyi district court of Dnipropetrovsk region.

On February 6, 2025,  the HCJ decided to dismiss Krasnoborov Oleksandr Valeriiovych from the position of the judge of the Podilskyi district court of Kyiv on his own volition by filling the relevant application.

High Council of Justice continues an effective cooperation with the EU Project “ПРАВО-JUSTICE” for reforming the judiciary

The meeting of the Steering Committee of the EU Project “ПРАВО–JUSTICE” was held in Kyiv. The Acting Chairman of the HCJ Dmytro Lukianov participated in the event and noted that with the support of international partners, in particular, the EU Project “ПРАВО-JUSTICE”, the HCJ fulfilled all the tasks planned for 2024.

In particular, acting Chairman of the HCJ drew attention to the support of the EU Project “ПРАВО–JUSTICE” of European integration processes within the framework of the negotiated Chapter 23 “Judiciary and Fundamental Rights”, in particular facilitating three rounds of “training/imitation sessions” in preparation for a bilateral meeting with the European Commission in Brussels, as well as consultations with European Commission experts on the development of a draft rule of law roadmap.

Judge Oleksandr Boyarskyi is temporarily suspended from administering justice based on the decision of the First Disciplinary Chamber of the HCJ

Judge of the Bilhorod-Dnistrovsky city district court of Odesa region Boyarskyi Oleksandr Oleksandrovych is temporarily suspended from administering justice based on the decision of the First Disciplinary Chamber of the High Council of Justice.

The decision to bring a judge to disciplinary liability and apply a disciplinary penalty to him in the form of submission for dismissal from the office was made by the First Disciplinary Chamber of the HCJ on February 3, 2025.

Judge Yevhenii Ablov is temporarily suspended from administering justice based on the decision of the First Disciplinary Chamber of the HCJ

Judge of the Circuit administrative court of Kyiv Ablov Yevhenii Valeriiovych is temporarily suspended from administering justice based on the decision of the First Disciplinary Chamber of the High Council of Justice.

The decision to bring a judge to disciplinary liability and apply a disciplinary penalty to him in the form of submission for dismissal from the office was made by the First Disciplinary Chamber of the HCJ on February 3, 2025.

HCJ dismissed judge of the Economic court of Kharkiv region for committing a significant disciplinary offence

On February 4, 2025, the High Council of Justice made a decision on dismissal Smirnova Olena Volodymyrivna from the position of the judge of the Economic court of Kharkiv region based on item 3 part six of Article 126 of the Constitution of Ukraine.

The realization of this procedure was carried out on the grounds of the submission of the Second Disciplinary Chamber of the High Council of Justice on dismissal of the judge from the office for committing a significant disciplinary offence, gross or systematic neglect of duty that is incompatible with the status of a judge or has revealed his incompatibility with the position held.

HCJ extended the term of temporal suspension of a judge of the Economic court of Lviv region from administering justice

On February 6, 2025, the HCJ partially satisfied the request of the deputy Prosecutor General – Head of the Specialized anticorruption prosecutor office and extended until March 9, 2025, the term of temporary suspension of a judge of the Economic court of Lviv region from administering justice due to bringing him to criminal liability.

The judge is suspected of committing a criminal offense under part two of Article 28, part three of Article 369-2 of the Criminal Code of Ukraine, namely promising to influence decision-making by persons authorized to perform state functions for the provision of an unlawful benefit, as well as receiving an unlawful benefit for himself and third parties for influencing decision-making by persons authorized to perform state functions, combined with extortion of such benefit, committed by a group of persons by prior conspiracy.

Start of the competition for a vacant position of a member of the High Qualification Commission of Judges of Ukraine is announced

According to part three of Article 92 of the Law of Ukraine “On the Judiciary and the Status of Judges”, the HQCJU shall consist of sixteen members, eight of which are appointed from among judges or retired judges.

On January 21, 2025, the HCJ decided to reject in appointing of candidates, recommended by the results of the competition, announced by the Selection Commission on April 5, 2024. In view of the above, in accordance with part nine of Article 95 of the Law, the Selection Commission for the Selection of HQCJU members announced a competition for the vacant position of a HQCJU member and invited candidates from among judges or retired judges to participate in the competition.

At the conference “Ukraine's Accession to the EU: Shaping the Transformational Agenda” held on February 7, 2025, in Kyiv, Acting Chairman of the High Council of Justice Dmytro Lukianov emphasized that the broad involvement of representatives of the judiciary in the negotiation process on Ukraine's accession to the European Union by the Ukrainian government demonstrates the awareness of the need to take into account the position of judges and judicial employees regarding the reform of the judiciary. This is evidence that Ukraine's European integration is based on the principles of cooperation, transparency and adherence to democratic standards.

In particular, Dmytro Lukianov noted that based on the results of the screening, the European Commission prepared a report on the compliance of Ukrainian legislation with EU law for each negotiation cluster, in which the European Commission noted the progress and high level of preparation of Ukraine in implementing reforms, but emphasized the need to continue efforts to achieve full compliance with EU membership criteria. In particular, it is important to ensure the independence, quality and efficiency of the judicial system of Ukraine.

HCJ dismissed judge of the Pishchanskyi district court of Vinnytsia region for committing a significant disciplinary offence

On February 11, 2025, the High Council of Justice decided to dismiss Shcherba Nadiia Leonidivna from the position of the judge of the Pishchanskyi district court of Vinnytsia region based on item 3 part six of Article 126 of the Constitution of Ukraine.

The realization of this procedure was carried out on the grounds of the submission of the Third Disciplinary Chamber of the High Council of Justice, which decided to bring judge of the Pishchanskyi district court of Vinnytsia region Shcherba Nadiia Leonidivna to disciplinary liability and apply a disciplinary penalty to her in the form of dismissal from the office.
