The HCJ will make submissions to the President of Ukraine on appointing five judges to local courts

On March 11, 2025,  the HCJ decided to make submissions to the President of Ukraine on appointing two judges for positions in local courts:

  • Mykhailiuk Olena Ihorivna – to the position of the judge of the Chutivskyi district court of Poltava region;
  • Hurskyi Serhii Vasyliovych – to the position of the judge of the Commercial court of Dnipropetrovsk region.

On March 18, 2025,  the HCJ decided to make submissions to the President of Ukraine on appointing three judges for positions in local courts, namely:

  • Shkarlat Yana Yuriivna to the position of the judge of the Mariinskyi district court of Donetsk region;
  • Melnyk Andrii Vasyliovych – to the position of the judge of the Korsun-Shevchenkivskyi district court of Cherkasy region;
  • Demianova Olha Anatoliivna – to the position of the judge of the Zhovtnevyi district court of Mariupol of Donetsk region.

HCJ left in force a chamber’s decision regarding dismissal of judges of Kyiv appellate court

On March 11, 2025, the HCJ decided to leave without changes the decision of the Second Disciplinary Chamber of the HCJ on bringing judges of the Kyiv appellate court Yurii Slyva, Ihor Palenyk, Viktor Hlynianyi to disciplinary liability.

Judges are suspected in committing of criminal offences, provided by part three of Article 28, part four of Article 368 of the CC of Ukraine (receipt by an official of an improper advantage in a substantial amount to himself/herself or a third party for an act by such official in favour of the person providing an improper advantage and in favor of a third party through abuse of power or official position by a group of people).

Eight judges resigned

On March 11, 2025,  the HCJ decided to dismiss due to filling applications for resignation:

  • Mykytiuk Olha Yuriivna – from the position of the judge of the Zhytomyr appellate court;
  • Kitaieva Svitlana Bohdanivna – from the position of the judge of the Commercial court of Lviv region.

On March 13, 2025, the HCJ decided to dismiss Hresko Vasyl Adamovych from the position of the judge of the Yemilchynskyi district court of Zhytomyr region due to his filling of the application for resignation.

On March 18, 2025,  the HCJ decided to dismiss due to filling applications for resignation:

  • Arkatova Kateryna Vitaliivna – from the position of the judge of the Dzerzhynskyi district court of Kharkiv;
  • Diachenko Viktor Hryhorovych – from the position of the judge of the Suvorovskyi district court of Odesa;
  • Voitiuk Vitalii Romanovych – from the position of the judge of the Commercial court of Rivne region.

On March 20, 2025, the decided to dismiss due to filling applications for resignation:

  • Bezdidko Volodymyr Mykolaiovych – from the position of the judge of the Prylutskyi city district court of Chernihiv region;
  • Buchatska Alla Ivanivna – from the position of the judge of the Saratskyi district court of Odesa region.

HCJ dismissed judge of the Bolhradskyi district court of Odesa region for committing a significant disciplinary offence

On March 11, 2025, the HCJ made a decision to dismiss the judge of the Bolhradskyi district court of Odesa region Vysotskyi Serhii Oleksandrovych based on the item 3 part six of Article 126 of the Constitution of Ukraine.

The realization of this procedure was carried out on the grounds of the submission of the Third Disciplinary Chamber of the HCJ on dismissal of the judge from the office for committing a significant disciplinary offence, gross or systematic neglect of duty that is incompatible with the status of a judge or has revealed his incompatibility with the position held (Article 109 of the Law of Ukraine “On the Judiciary and the Status of Judges”).

Judge is suspected in committing criminal offences, as provided by part four of Article 27, part three of Article 369, part one of Article 190 of the Criminal Code of Ukraine.

Opinions of the CCJE have a positive impact on reforming the judiciary and bringing it closer to European standards

This was stated by the Chairman of the HCJ, Hryhorii Usyk, in his speech at the event dedicated to the presentation of Opinion No. 27 (2024) of the Consultative Council of European Judges “On the Disciplinary Liability of Judges” and the Recommendations on the Judicial Independence and the Judicial Accountability (Warsaw Recommendations) of the OSCE Office for Democratic Institutions and Human Rights (ODIHR).

The CCJE Opinion No. 27 (2024) states that the scope of disciplinary liability should be clearly defined. The law should clearly and, to the extent possible, specifically define the grounds on which disciplinary proceedings against judges may be initiated. Vague provisions (such as “breach of oath” or “unethical behaviour”) are subject to overly broad interpretation and abuse, which may be dangerous for the independence of judges.

Hryhorii Usyk noted that the need to introduce relevant legislative changes to improve the grounds and procedure for bringing judges to disciplinary liability in accordance with European standards is long overdue.

HCJ dismissed judge of the Kyiv circuit administrative court for committing a significant disciplinary offence

On March 18, 2025, the HCJ made a decision on the dismissal Vovk Pavlo Viacheslavovych from the office of the judge of the Kyiv circuit administrative court based on item 3 part six of Article 126 of the Constitution of Ukraine.

The realization of the mentioned procedure was carried out on the grounds of the submission of the Third Disciplinary Chamber of the HCJ on bringing the judge of the Kyiv circuit administrative court Vovk Pavlo Viacheslavovych to disciplinary liability and applying a disciplinary penalty to him in the form of submission for dismissal from the position of the judge.

Judge of the Poltava appellate court Tomylko Valentyn Petrovych has been temporarily suspended from administering justice based on the decision of the Third Disciplinary Chamber of the HCJ

The decision to bring a judge to disciplinary liability and apply a disciplinary penalty to him in the form of submission for dismissal from the office was made by the Third Disciplinary Chamber of the HCJ on March 19, 2025.

HCJ Secretariat announces the start of receiving documents from candidates for election of two HCJ members by XX regular congress of judges of Ukraine, which continues its work on May 27 – 29, 2025

According to the decision of the Council of Judges of Ukraine of March 18, 2025, No. 13, received by the High Council of Justice on March 19, 2025, May 27 – 29, 2025, was set as a date of continuation of work of the XX Regular Congress of Judges of Ukraine after the break.

According to Articles 8, 9, 10 of the Law of Ukraine “On the High Council of Justice”, the HCJ Secretariat shall announce the start of accepting documents from candidates to participate in a new competition for the election of members of the HCJ by the Congress of Judges of Ukraine.

Given that the last day for submitting documents is April 26, 2025, (Saturday), the documents will be accepted until 24:00 on April 28, 2025, if the documents are submitted electronically (official HCJ email addressassistant@hcj.gov.ua), or until 17:00 on April 28, 2025, if the documents are submitted in person (address: Kyiv, Studentska street 12-а).

HCJ dismissed judge of the Avdiivskyi city court of Donetsk region, who does not comply with the office held, according to the results of qualification assessment

During its session on March 20, 2025, the HCJ made a decision to dismiss Panchenko Olena Oleksandrivna from the office of the judge of the Avdiivskyi city court of Donetsk region based on the subitem 4 of item 16¹ of Chapter ХV “Transitional provisions” of the Constitution of Ukraine.

The decision was made according to the submission with the recommendation of the HQCJU, stating that Olena Panchenko does not comply with the office held, based on the results of the qualification evaluation of judges of local courts.

On March 20, 2025, the HCJ made a decision on the dismissal Mazur Aliona Serhiivna from the office of the judge of the Kyiv circuit administrative court based on item 3 part six of Article 126 of the Constitution of Ukraine.

The realization of this procedure was carried out on the grounds of the submission of the First Disciplinary Chamber of the HCJ on bringing the judge of the Kyiv circuit administrative court Mazur Aliona Serhiivna to disciplinary liability and applying a disciplinary penalty to her in the form of submission for dismissal from the position of the judge.
