HCJ supported the unblocking of disciplinary proceedings against judges

The HCJ approved an advisory opinion on the draft Law of Ukraine “On making amendments to certain laws of Ukraine on the resumption of consideration of cases on disciplinary liability of judges and ensuring the work of the Disciplinary Inspectorate Service of the High Council of Justice” (No. 9261).

The HCJ shares the position of the legislator regarding the need to restore the disciplinary function of the Council as soon as possible and notes that the implementation of the draft law will allow to resume consideration of cases on disciplinary liability of judges and ensure the beginning of work and functioning of the of Disciplinary Inspectorate Service of the High Council of Justice.

Hryhorii Usyk spoke about the HCJ strategy at the current stage of operation

As part of the training of heads and deputy heads of courts of appeal, local general, economic, district administrative courts, the Chairman of the HCJ, Hryhorii Usyk, gave a lecture on the topic: “The HCJ as a key constitutional body of the judiciary. Strategy at the present stage”.

HCJ dismissed 11 judges for resignation

On May 23, 2023 the HCJ decided to dismiss under submission of application for resignation seven judges (of which, one judge of the Supreme Court and two – judges of courts of appeal):

  • Domariev Oleksandr Viktorovych – from the office of judge of the Darnytskyi district court of the city of Kyiv;
  • Ivanko Lidiia Andriivna – from the office of judge of the Economic court of Poltava region;
  • Kuznetsov Vadym Oleksandrovych – from the office of judge of the Central economic court of appeal;
  • Matiiek Tetiana Vasylivna – from the office of judge of the Supreme Court;
  • Pavlova Zhanna Petrivna – from the office of judge of the Zavodskyi district court of the city of Mykolaiv;
  • Heza Taisiia Dmytrivna – from the office of judge of the Eastern economic court of appeal;
  • Koval Volodymyr Oleksandrovych – from the office of judge of the Velykooleksandriivskyi district court of Kherson region.

On May 25, 2023   the HCJ decided to dismiss under submission of application for resignation:

  • Bagrova Anzhelika Gennadiivna – from the office of judge of the Nikopolskyi local-district court of Dnipropetrovsk region;
  • Kolosovskyi Serhii Yuriiovych – from the office of judge of the Mykolaiv court of appeal;
  • Semeniuk Tetiana Anatoliivnaу – from the office of judge of the Kyiv court of appeal;
  • Kyrylenko Tetiana Valentynivna – from the office of judge of the Sviatoshynskyi district court of the city of Kyiv.

Procedure of secondment of judges to three courts has began

According to the decisions dated May 23, 2023  № 514/0/15-23№ 515/0/15-23 and № 517/0/15-23 the HCJ announced the beginning of the procedure for seconding judges to another court of the same level and specialization to administer justice, in particular, to:

  • Valkivskyi district court of Kharkiv region – 1 judge;
  • Kyivskyi district court of the city of Poltava – 8 judges;
  • Zarichnyi district court of the city of Sumy – 5 judges.

Judges who expressed the wish to be seconded to mentioned court should submit to the High Council of Justice within ten days (from the date of the announcement of the beginning of the procedure for seconding judges) necessary documents. The list of the documents is here.

The term for judges to give consent to a secondment to four courts has been extended

The HCJ, by its decisions dated May 23, 2023 № 508/0/15-23№ 509/0/15-23№ 510/0/15-23№ 511/0/15-23 extended the period for the judges to give consent to the secondment of:

  • 2 judges to the Apostolivskyi district court of Dnipropetrovsk region;
  • 5 judges to the Sumy court of appeal;
  • 1 judge to the Ternivskyi local court of Dnipropetrovsk region;
  • 1 judge to the Olevskyi district court of Zhytomyr region.

Judges who expressed the wish to be seconded to mentioned courts should submit to the High Council of Justice necessary documents by June 2, 2023. The list of the said documents is here.

HCJ seconded two judges to admiister justice to the Novozavodskyi district court of Chernihiv

In order to regulate the workload in the Novozavodskyi district court of the city of Chernihiv, on May 25, 2023, the HCJ decided to second for administering justice judge of the Prylutskyi local-distric court of Chernihiv region Pavlov Volodymyr Hryhorovych and judge of the Kulykivskyi district court of Chernihiv region Libster Andrii Serhiiovych for one year from May 29, 2023.

HCJ extended the term of temporary suspension from the administration of justice of judge of the Koretskyi district court of the Rivne region Yevhen Kulyk

On May 26, 2023, the HCJ upheld the motion of the Deputy Prosecutor General – the Head of the Specialized Anti-Corruption Prosecutor's Office and extended until July 26, 2023 the term of temporary suspension from the administration of justice of judge of the Koretskyi district court of Rivne region Yevhen Volodymyrovych Kulyk due to criminal prosecution. The judge is suspected of committing a criminal offense under the third part of Article 368 of the Criminal Code of Ukraine.

The term of temporary suspension of judge of the Kyivskyi district court of the city of Odesa Liudmyla Saltan from the administration of justice has been extended

On May 26, 2023, the HCJ upheld the motion of the Deputy Prosecutor General – the Head of the Specialized Anti-Corruption Prosecutor's Office and extended until July 26, 2023 the term of temporary suspension from the administration of justice of judge of the Kyivskyi district court of the city of Odesa Saltan Liudmyla Volodymyrivna due to criminal prosecution. The judge is suspected of committing a criminal offense under the third part of Article 368 of the Criminal Code of Ukraine.

The new President of the Supreme Court took the oath of a member of the HCJ

Plenum of the Supreme Court by secret ballot elected Kravchenko Stanislav Ivanovych as the new President of the Supreme Court.

The President of the Supreme Court is an ex officio member of the HCJ and shall take the oath of a member of the HCJ at the meeting of the Plenum of the Supreme Court at which he/she was elected to this office.

The HCJ granted its consent to the detention of judge Oleksii Tandyr

On May 27, 2023 the HCJ granted its consent to keep the judge of the Makarivskyi district court of Kyiv region Oleksii Tandyr.

The said decision was taken following the consideration of the Deputy Prosecutor General's submission.

Tandyr O.V. is suspected of committing a criminal offense under the third part of Article 286-1of the Criminal Code of Ukraine.
