There are no grounds to pay judicial remuneration to judges who have reached the age of 65

In order to avoid differences in practice and to prevent formation of different approaches to the payment of monetary allowances to judges who have reached the age of sixty-five, the High Council of Justice draws attention of heads of courts to the following.

According to Article 126 of the Constitution of Ukraine, the authority of a judge shall be terminated in the case of attaining the age of sixty-five. Article 120 of the Law of Ukraine “On the Judiciary and the Status of Judges” establishes that the powers of a judge shall be terminated the next day after he/she reaches the age of sixty-five. According to Article 125 of the said Law, the termination of the judge’s powers shall be deemed sufficient grounds for the termination of employment at the relevant court, and the court chairperson shall issue a relevant order.

Therefore, clear and unambiguous legislative norms do not provide any grounds for accruing and paying judicial remuneration to judges who have reached sixty-five years of age.

The Secretariat of the High Council of Justice has finished accepting documents from candidates for election to membership of the High Council of Justice by the Congress of representatives of higher education and research institutions in the area of law

Activities of the HCJ Secretariat in figures for January-November 2022

The Secretariat of the High Council of Justice continues to perform its functions uninterruptedly in the conditions of martial law.

1 965 appeals from citizens and 255 requests for information were considered by employees of the Secretariat of the High Council of Justice during eleven months of 2022. For the period 2 738 appeals from citizens were received to the HCJ hotline at the telephone number: (044) 481-06-26.

Since the beginning of 2022, by the Secretariat employees there were prepared 2 205 cover letters on sending copies of the acts of the HCJ and its bodies; 4 605 copies of the acts of the HCJ, its bodies and members of the HCJ were issued; 3 930 pages of draft documents of the HCJ were edited.

During August-September 2022, at the request of the Ethics Council, the Secretariat employees scanned about 58 000 pages of cases (disciplinary complaints, annexes to complaints, decisions taken by the HCJ, its bodies and members of the Council, etc.).
