10 judges were dismissed on general grounds

The HCJ decided to dismiss nine judges due to submission of application for resignation:

  • Burda Nadiia Mykolaivna – from the office of judge of the Economic court of Ternopil region;
  • Klapoushchak Serhii Yuriiovych – from the office of judge of the Vinnytskyi local court of Vinnytsia region;
  • Semenov Oleh Anatoliiovych – from the office of judge of the Illichivskyi local court of Odesa region.
  • Poprevych Viktor Mykhailovych – from the office of judge of the Prymorskyi district court of the city of Odesa;
  • Lisovska Olena Volodymyrivna – from the office of judge of the Desnianskyi district court of the city of Kyiv;
  • Vyshar Ihor Yuriiovychа – from the office of judge of the Vinnytskyi local court of Vinnytsia region.
  • Smarovoz Mykhailo Vasylovych – from the office of judge of the Economic court of Khmelnytskyi region;
  • Antonenko Nataliia Oleksandrivna – from the office of judge of the Supreme Court;
  • Liubynetska-Onilova Alla Hryhorivna – from the office of judge of the Yampilskyi district court of Vinnytsia region.

The HCJ has also dismissed Pyrohova Liliia Volodymyrivna from the office of judge of the Selydivskyi local court of Donetsk region due to inability to exercise her powers on the health reasons.

HCJ dismissed Serhii Poida from the office of judge of the Darnytskyi district court of the city of Kyiv

On October 24, 2023, the HCJ took decision on dismissal of Serhii Poida from the office of judge of the Darnytskyi district court of the city of Kyiv under paragraph 3 of part 6 of Article 126 of the Constitution of Ukraine (committing a significant disciplinary misdemeanour, gross or systematic disregard of his/her duties, which is incompatible with the status of judge or has shown his/her incompatibility with the position held).

Members of the HCJ are studying experience of Spain in the field of disciplinary practice

With the support of the Council of Europe Project “Support to the functioning of justice in the war and post-war context in Ukraine” members of the HCJ paid visit to the General Council for the Judiciary of Spain. The main topic of the working visit is to study the Spanish experience in the field of implementing disciplinary practice.

Challenges facing courts in considering cases of international (war) crimes were discussed at an international conference

Deputy Chairman of the High Council of Justice Dmytro Lukianov took part in the three-day international conference “Justice in the domestic adjudication of war crimes cases”

Dmytro Lukianov noted that the main burden of restoring justice for victims of international crimes and bringing all perpetrators to responsibility will fall precisely on the national judicial system. He analyzed the normative, personnel, financial, organizational and other problems that should be resolved to consider this category of cases.

The Deputy Chairman of the High Council of Justice noted that the results of joint work can be systematized in the draft Strategy for investigation and prosecution for international crimes. It will coordinate the activities of all bodies of the legislative, executive and judicial branches of government.

HCJ postponed the resumption of work of the Bilozerskyi district court of Kherson region

On October 31, 2023, the HCJ decided to postpone beginning of the work resumption of the Bilozerskyi district court of Kherson region until December 1, 2023.

The Khersonskyi local court of Kherson region will continue to consider cases submitted to this court until November 30, 2023 inclusive.

Documents of candidates to the vacant position of the Deputy Head of the State Judicial Administration of Ukraine in charge of digital development are being accepted

The HCJ, by its decision of October 19, 2023, announced the availability of the vacant position of the Deputy Head of the State Judicial Administration of Ukraine for digital development, digital transformation and digitalization, and also approved the Terms for holding the specified vacant position.

In accordance with these terms, submission of documents of candidates shall end at 24 hours on November 10, 2023, if documents are submitted in electronic form, or at 15:45 on November 10, 2023, if documents are submitted in person.

Automated distribution of disciplinary complaints among the members of the HCJ has begun

Starting from November 1, 2023, according to the decision of the High Council of Justice No. 997/0/15-23, the distribution of complaints is restored among the members of the HCJ about disciplinary misconduct of a judge and complaints against decisions to impose a judge or prosecutor to disciplinary responsibility.

HCJ temporary suspended judge Pavlo Dobrov from the administration of justice

On October 31 the HCJ partially satisfied petition of the Deputy Prosecutor General – Head of the Specialized Anti-Corruption Prosecutor’s Office Oleksandr Klymenko and temporary until November 30, 2023 suspended judge of the Kominternivskyi district court of Odesa region Pavlo Dobrov from the administration of justice due to bringing to criminal liability. The judge is suspected of committing a criminal offense provided for in part 3 of Article 368 of the Criminal Code of Ukraine.

288 judges have been dismissed since the beginning of 2023

During January – October 2023 the HCJ dismissed 282 judges on general grounds263 were dismissed due to the submission of applications for resignation19 judges were dismissed due to the submission of applications for dismissal at own will.

Under special grounds, the High Council of Justice dismissed 6 judges, namely for committing a significant disciplinary offense.

HCJ appointed Pavlo Malykhin the Head of the Court Security Service

At its meeting of November 2, 2023 the High Council of Justice decided to appoint Pavlo Malykhin to the position of the Head of the Court Security Service.

Activity of the HCJ Secretariat in figures during January – October 2023

During ten months of 2023, employees of the HCJ Secretariat considered about 6000 citizens’ appeals and almost 500 requests for information; 3089 appeals from citizens were received to the HCJ hotline at the telephone number: (044) 481-06-26.

By employees of the HCJ Secretariat 1937 cover letters on sending copies of the acts of the HCJ and its bodies were prepared, 4266 copies of the acts of the HCJ, its bodies and members of the HCJ were issued, 18 073 5021 pages of draft documents of the HCJ were edited.

Optimization of the network of courts should be citizen-oriented – Hryhorii Usyk

Representatives of the judicial branch of government, parliamentary corps, and law enforcement bodies discussed the need to optimize the map of courts in Ukraine and plans for the reconstruction and restoration of courts damaged as a result of hostilities, during online meeting organized on November 1, 2023 by the USAID Justice for All Activity.

Chairman of the HCJ Hryhorii Usyk noted that the reorganization of courts should be carried out systematically and in complex, since the final consumer of court services is always a citizen.

“When motivating the expediency to optimize the network of courts by reducing their maintenance costs, we should not forget about ensuring the optimal load on each court. By itself, the consolidation of the court does not lead to a reduction in the workload. The population and internal migration should be taken into account,” Hryhorii Usyk emphasized.
