HCH resigned six judges

On September 12, 2023,the HCJ decided to dismiss four judges due to filing of applications for resignation, namely:

  • Dryhval Valerii Mykolaiovych – from the office of judge of the Vysokopilskyi district court of Kherson region (seconded to the Novoukrainskyi district court of Kirovohrad region);
  • Koverznev Vadym Oleksandrovych – from the office of judge the Desnianskyi district court of the city of Chernihiv;
  • Starovetskyi Volodymyr Ivanovych – from the office of judge the Slovianskyi local-district court of Donetsk region;
  • Pavlenko Olha Vladyslavivna – from the office of judge the Ripkynskyi district court of Chernihiv region.

On September 19, 2023, two judges were dismissed due to filing of applications for resignation:

  • Kniazieva Nataliia Viacheslavivna – from the office of judge the Inhuletskyi district court of Kryvyi Rih Dnipropetrovsk region;
  • Zhyvotov вYevhen Gennadiiovych – from the office of judge of the Court of appeal of Zakarpattia region.

Serhii Burlakov: a special tribunal for the crime of aggression - why is this needed now?

Why should this tribunal be created now of all times? Not only Ukraine and its people need this, the whole world needs it, so that the crime of aggression does not go unpunished, so that post-truth does not swallow it up. The dark times are back. HCJ extended the term of temporary suspension from the administration of justice of judge of the Prymorskyi district court of Odesa  Illia Lonskyi

On September 14, 2023, the HCJ satisfied petition of the Deputy Prosecutor General – Head of the Specialized Anti-Corruption Prosecutor’s Office Oleksandr Klymenko and extended the term of temporary suspension from the administration of justice until November 20, 2023 of judge of the Prymorskyi district court of Odesa Illia Lonskyi in connection with criminal prosecution.

The judge is suspected of committing a criminal offense under part 3 of Article 15, part 3 of Article 369, part 2 of Article 190 of the Criminal Code of Ukraine, namely, an attempt to provide an improper advantage to another judge for making a positive decision in a case of an administrative offense, as well as taking part of the improper advantage by deceiving a judge of the Prymorskyi district court of Odesa – shall be punishable by imprisonment for a term of four to eight years with forfeiture of property.

HCJ addressed the Prosecutor General Office regarding the investigation of the case regarding the forgery of court decisions

According to the information of judge Viktor Viktorov, the court received a letter from the prosecutor of the Mohilev-Podilskyi Circuit Prosecutor's Office with a request to confirm the fact that three decisions were made, on the basis of which the person's ownership of agricultural land plots was registered in the State Register of Real Rights to Immovable Property.

The rulings were allegedly issued on behalf of judges of the Leninskyi district court of Kharkiv Protsenko L.H., Borodina O.V., Viktorov V.V.

The judges noted that they have never made decisions in favour of the plaintiff, signatures in this decisions do not belong to any of them, the seal imprint does not correspond the seal imprint of the Leninskyi district court of Kharkiv, the mentioned court cases do not exist.

HCJ and the EU Pravo-Justice Project identified urgent areas for further cooperation

During the meeting held on September 13, 2023, the HCJ members and representatives of the EU Pravo-Lustice Project discussed further areas of cooperation to improve the work of the judicial system of Ukraine and ensure its sustainability in modern conditions.

New date of the Congress of Legal Scholars has been determined

Taking into account the need for the Ethics Council to complete all stages of selecting candidates for the position of member of the HCJ, a new date has been determined, as well as the time of the Congress of Representatives of Higher Education and Research Institutions in the Area of Law.

It is planned that the congress will begin its work on November 16, 2023 at 13:00 in the premises of the Kyiv National University of Trade and Economics at the address: Kyiv, 19, Kyoto St.

Practice of considering complaints by the HCJ against decisions in disciplinary proceedings against prosecutors has been summarized

The HCJ Secretariat has prepared summary of the practice of consideration by the Council of complaints against decisions in disciplinary proceedings against prosecutors during 2017-2021.

The synthesis of practice is important for standardizing the law enforcement activities of the HCJ, and also serves as a kind of reference point for the body carrying out disciplinary proceedings against prosecutors (Qualification and Disciplinary Commission of Prosecutors), for prosecutors against whom decisions have been made, as well as for persons who have filed a disciplinary complaint.
