
On January 26, 2023 during the meeting, the High Council of Justice decided to clarify its comments and suggestions to the draft resolution of the Cabinet of Ministers of Ukraine “On approval of the State Anti-Corruption Program for 2023-2025”. The clarifications are set out in today's decision appendix.
In particular, the HCJ:
- considers it necessary to establish a norm that the conduct of qualification assessment procedures should not lead to a re-evaluation of those judges who underwent such qualification assessment during the initial qualification assessment procedures, competitive procedures or selection procedures;
- stands for a clear definition of the status, scope of authority and responsibility of the Public Integrity Council, a clear regulation and determination of objective criteria for candidates to become member of the PIC, as well as the introduction of an effective control mechanism for the resolution of conflicts of interest in the activities of the members of the PIC in accordance with the GRECO recommendations;
Special additions relate to the settlement of financial aspects and the implementation of the IJITS.
It should be reminded that on January 19, 2023, the High Council of Justice adopted its decision “On the position of the High Council of Justice on the draft resolution of the Cabinet of Ministers of Ukraine “On approval of the State Anti-Corruption Program for 2023-2025”.
On January 24, 2023, a working meeting was held, which was attended by the member of the High Council of Justice Mykola Moroz, Deputy Head of the Secretariat - Head of Department for Preventing and Detecting Corruption of the Secretariat of the HCJ Oleksandr Seriohin, representatives of the National Agency on Corruption Prevention.
By results of the meeting, there was a need to clarify the comments and suggestions set out in the appendix to the decision of the High Council of Justice on the position of the Council.
