On January 9, 2020 the High Council of Justice considered dismissal from office of Olena Lytvynenko, judge of Baryshivskyi district court of Kyiv region on grounds specified in Paragraph 3 of part six of Article 126 of the Constitution of Ukraine in accordance with the decision of the First Disciplinary Chamber of the High Council of Justice dated November 15, 2019 № 3002/1дп/15-19.
Speaker – member of the High Council of Justice Viktor Matviichuk has informed that the First Disciplinary Chamber of the High Council of Justice on November 15, 2019 adopted decision № 3002/1дп/15-19 on bringing judge of the Baryshivskyi district court of the Kiev region Lytvynenko O.L. to disciplinary liability and imposing disciplinary sanction in the form of submission on dismissal from office.
Having considered complaint of judge Lytvynenko O.L. the High Council of Justice took decision as of December 24, 2019 № 3002/1дп/15-19 that uphold decision of the First Disciplinary Chamber of the High Council of Justice of November 15, 2019 № 3002/1дп/15-19.
It should be reminded that disciplinary case concerning judge of Baryshivskyi district court of Kyiv region Lytvynenko O.L. was opened on disciplinary complaints against judge's actions during proceeding in case № 355/771/19 by claim of PERSON-1 against LLC Airline “Skyup” for protection of consumer rights, termination of actions that violate law and enforcement of duties in kind.
The First Disciplinary Chamber concluded that information stated in complaints of lawyer Tolkachov D.I. and People`s Deputy of Ukraine Herashchenko A.Yu. indicates the presence in the actions of judge of the Baryshevsky district court of the Kiev region A.L. Litvinenko signs of a disciplinary offense provided by subparagraph “a” of paragraph 1 and paragraph 4 of part one of Article 106 of the Law of Ukraine “On the Judicial System and Status of Judges” (a significant violation of procedural law in executing of justice that led to violation of the rules of jurisdiction; gross negligence, violations of human rights and fundamental freedoms, interference in the economic activities of company).
The High Council of Justice decided to dismiss from office on grounds specified in Paragraph 3 of part six of Article 126 of the Constitution of Ukraine Olena Lytvynenko, judge of Baryshivskyi district court of Kyiv region.
