HCJ gave its consent on the keeping of a judge of the Turkivskyi district court of Lviv region under the custody

The High Council of Justice at its session on April 9, 2020, made a decision to satisfy the submission of the Deputy Prosecutor General - Head of the Specialized Anti-Corruption Prosecutor's Office Kholodnytskyi Nazar Ivanovych on giving consent on keeping under the custody a judge of the Turkivskyi district court of Lviv region Kril Luka Mykhailovych and to give its consent on keeping a judge under the custody.

During the session, the High Council of Justice processed the submission and copies of materials added to it, heard out the spokesperson – member of the High Council of Justice Shapran V.V., the representative of the Prosecutor’s General Office – prosecutor of the first division of the department of the procedural leadership, support of state prosecution and representation in court of the Specialized Anti-Corruption Prosecutor's General Office Shkrum V.M., explanations of a judge Kril L.M. and his representative – advocate Ketsko V.Ia.

The judge of the Turkivskyi district court of Lviv region Kril L.M. and the representative of the judge by the petition of the judge participated in the session of the HCJ in the video conferencing from the premises of the Sykhivskyi district court of Lviv.

It should be reminded that on November 21, 2019, the HCJ, by the petition of the SAP, temporarily suspended the judge of the Turkivskyi district court of Lviv region Kril L.M. from administering justice due to bringing him to criminal liability for committing the criminal offense provided by part three of Article 368 of the Criminal Code of Ukraine, until the entry into force of a court judgment or the closure of criminal proceeding.

At present, the case is on consideration of the High Anti-corruption court.

On March 2, 2020, the judge of the Turkivskyi district court of Lviv region Kril L.M. was issued a notification on suspicion in committing a criminal offense, drawn up at the same day by the Deputy Prosecutor General - Head of the Specialized Anti-Corruption Prosecutor's Office Kholodnytskyi N. I.

During the session of the HCJ was established that after the suspension the judge Kril L.M. did not take actions to return the materials of the case No. 458/867/19 regarding bringing to the administrative liability of a person for further direction to another court, at the same time he continued to exercise the powers of the chief judge of the court. As a result, the proceeding on the mentioned case was closed by the court due to expired term.

The High Council of Justice established that the submission of the Deputy Prosecutor General - Head of the Specialized Anti-Corruption Prosecutor's Office Kholodnytskyi N. I. on giving consent on keeping under the custody the judge of the Turkivskyi district court of Lviv region Kril L.M. complies with specified requirements of the law, and to motives, given in the submission are justified.
