
The High Council of Justice decided to postpone for a month the resumption of the territorial jurisdiction of court cases of the Kherson Court of Appeal, the Bilozerskyi, Velykooleksandrivskyi, Novovorontsovskyi district courts of Kherson region.
It should be reminded that by the order of the President of the Supreme Court of January 10, 2023, the territorial jurisdiction of court cases in these courts was renewed from February 1, 2023.
However, on January 17, 2023, the High Council of Justice received an appeal of the deputy head of apparatus of the Bilozerskyi district court of Kherson region with a request to postpone the resumption of the court's work until the shelling stops and the possibility of proper technical support of the court. In addition, on January 25, 2023, the Council received an appeal of the head of the Kherson Court of Appeal with a request to consider postponing the resumption of four courts work until March 1, 2023, given the security situation and condition of the premises.
According to the Territorial Department of the State Judicial Administration of Ukraine in Kherson region and the Territorial Department of the Court Security Service, it is impossible to resume work on the premises of the Bilozerskyi, Velykooleksandrivskyi, Novovorontsovskyi district courts of Kherson region. The courts are within the reach of long-range artillery of the troops of the russian federation, while they do not have bomb shelters or hideouts. The premises suffered significant destruction and damage – both external and internal, namely damaged heating systems, windows, there is no Internet connection. Equipment and furniture during the temporary occupation of Kherson region and hostilities were stolen or damaged by the invaders, and this excludes the possibility of their further exploitation.
Therefore, the HCJ, taking into account security threats and impossibility of resuming the territorial jurisdiction of court cases in these courts from February 1, 2023, decided to establish the beginning of the restoration and change of territorial jurisdiction of court cases of these courts from March 1, 2023.
The Odesa Court of Appeal, the Kyivskyi, Malynovskyi, Prymorskyi, Suvorovskyi district courts of the city of Odesa, the Biliaivskyi, Kominternivskyi district courts of Odesa region, the Teplodarskyi local court of Odesa region will continue consideration of transferred cases.
