The HCJ provided the HQCJU with information to form judicial dossiers of more than five thousand judges

In order to form judicial dossier, the Secretariat of the High Council of Justice prepared and provided the High Qualification Commission of Judges of Ukraine with information in electronic form regarding the total number of complaints received by the High Council of Justice (former) and the High Council of Justice in 2014-2021 against 5249 judges.

In particular, information on judges whose five-year term of office has expired was provided as a priority; judges in respect of whom the High Council of Justice has refused to submit a proposal for dismissal from the position of a judge; those who continue to participate in competition for the position of a judge of the High Court of Intellectual Property and the Appellate Chamber of the High Court of Intellectual Property (591 judges in total).

It should be noted that according to the first part of Article 93 of the Law of Ukraine “On the Judiciary and the Status of Judges”, the High Qualification Commission of Judges of Ukraine shall ensure the management of a judicial dossier.

The judicial dossier should contain copies of all decisions taken against the judge by the High Council of Justice, the High Council of Justice (former), and information on the disciplinary responsibility of the judge. Information on the disciplinary responsibility of a judge is included in the judicial dossier upon the relevant notification of the High Council of Justice.

In August 2022, the High Qualification Commission of Judges of Ukraine addressed to the High Council of Justice with a request to provide information on the number of disciplinary complaints for each judge separately, disaggregated by year, attaching a list of such judges.

In order to fill judicial dossiers with data on disciplinary liability of a judge since 2017, the HCJ has been systematically sends to the HQCJU notifications  about decisions taken by the Disciplinary Chambers in disciplinary proceedings and the High Council of Justice on complaints against decisions in disciplinary cases against judges with copies of the relevant decisions attached.

Information was also sent in the tabular form proposed by the HQCJU regarding the decisions adopted by the members of the Council on leaving complaints against the actions of judges without consideration.
