
In connection with the publication in the media of information about the establishment by the state sponsor of terrorism of pseudo-courts in the occupied territories of Ukraine, the High Council of Justice considers it necessary to emphasize the following.
Ukraine shall be a sovereign and independent, democratic, social, law-based state. The sovereignty of Ukraine shall extend throughout its entire territory.
Courts in Ukraine shall be established and operate in accordance with the Constitution and laws of Ukraine.
Delegation of the functions of courts, the establishment of extraordinary and special courts as well as appropriation of such functions by other bodies or officials shall be prohibited.
Any person arrogating to himself/herself the functions of a court shall be held responsible as provided by law.
In administering justice on the basis of the rule of law, the court shall guarantee everyone the right to a fair trial and ensure respect for other rights and freedoms guaranteed by the Constitution and laws of Ukraine, as well as international treaties ratified by the Verkhovna Rada of Ukraine.
Decisions of the fake courts established in the occupied territories shall be considered null and void.
Appeal to these courts will testify to the recognition of illegitimate authorities unlawfully created by the russian federation in the occupied territory and will contribute to their occupation activities.
Voluntary holding of an office by citizens of Ukraine in illegal judicial bodies established in the temporarily occupied territory may have signs of collaboration activity, which shall be recognized as a betrayal of Ukrainian citizens and the interests of their state, and shall be punished according to the Criminal Code of Ukraine.
