
The High Council of Justice during its meeting of April 11, 2023 decided to terminate the resignation of the judge Oleh Yushchuk in connection with the entry into force of conviction against him for committing an intentional crime.
Yushchuk O.S. was dismissed from the office of judge of the Lutskyi local-district court of Volyn region in December, 2022 by the decision of the High Council of Justice in connection of the submission of application for resignation.
According to Article 145 of the Law of Ukraine “On the Judiciary and the Status of Judges”, one of the grounds for terminating the resignation of a judge is the entry into force of a judgement of guilt against such judge.
According to the conviction of the High Anti-Corruption Court Yushchuk O.S. was found guilty of committing a criminal offense under the second part of Article 3692 of the Criminal Code of Ukraine (obtaining unlawful benefits for himself for influencing the decision-making by a person authorized to perform the functions of the state), sentenced to imprisonment for three years. The sentence has entered into force, and therefore there are legal grounds for terminating the resignation of Yushchuk O.S.
Termination of the judge’s resignation shall be the ground to terminate the payment of judge’s lifetime monthly allowance in connection with the retirement. A copy of the Council’s decision will be sent to the Pension Fund of Ukraine.
