
Entry into force of changes the Regulations on the procedure for functioning of certain subsystems (modules) of the Integrated Judicial Information and Telecommunication System was postponed until June 1, 2022 by the decision of the President of the Supreme Court.
The High Council of Justice approved the Amendments to the Regulations on the procedure for functioning of certain subsystems (modules) of the IJITS. The Regulation was amended with Section IV “Peculiarities of automated distribution of court cases”, which establishes the rules for distribution of court cases between judges, the powers of the meeting of judges to carry out automated distribution etc.
The changes were supposed to enter into force on March 15, 2022. The State Judicial Administration of Ukraine, the Kyiv Court of Appeal, the Supreme Court were to ensure that by this date the automated distribution of court cases in courts was brought into line with the approved amendments.
However, during the martial law imposed in Ukraine on February 24, 2022 in response to the armed aggression of Russia, the courts have to work in difficult conditions. Often it is not possible to convene a meeting of judges to approve in court the peculiarities of the automated distribution of cases. Therefore, introduction of new rules for the automated distribution was postponed until June 1, 2022.
The powers to make these decisions came to the President of the Supreme Court on March 22, 2022 by the entry into force of the Law of Ukraine “On making amendments to Section XII “Final and Transitional Provisions” of the Law of Ukraine “On the Judiciary and the Status of Judges” on ensuring the sustainable functioning of the judiciary in the absence of plenipotentiary membership of the High Council of Justice”.
