
The High Council of Justice took decision to terminate the resignation of four judges in connection with the entry into force of convictions against each of them.
Article 145 of the Law of Ukraine “On the Judiciary and the Status of Judges” establishes that one of the grounds for terminating resignation of a judge is the entry into force of a conviction against such judge for committing an intentional crime.
In particular, the judgments gained legal force:
Of the Mlynivskyi district court of Rivne region in regard of the judge of the Kivertsivskyi district court of Volyn region Ivan Pidhornyi for committing the crime under the second part of Article 368 of the Criminal Code of Ukraine.
Of the High Anti-Corruption Court in regard of the judge of the Malynovskyi district court of Odesa Oleksii Buran for committing the crime under the third part of Article 368 of the Criminal Code of Ukraine.
Of the High Anti-Corruption Court in regard of the judge of the Sievierodonetskyi local court of Luhansk region Olena Horbatenko for committing the crime under the third part of Article 368 of the Criminal Code of Ukraine.
Of the High Anti-Corruption Court in regard of the judge of the Kovelskyi local-district court of Volyn region Oleh Vasyliuk for committing the crime under the second part of Article 3692 of the Criminal Code of Ukraine.
Considering the above, in accordance with Article 145 of the Law of Ukraine “On the Judiciary and the Status of Judges” and Article 3 of the Law of Ukraine “On the High Council of Justice”, the Council decided to stop the resignation of judges Ivan Pidhornyi, Oleksii Buran, Olena Horbatenko, Oleh Vasyliuk in connection with the entry into legal force of convictions against each of them for committing an intentional crime.
Termination of the judge’s retirement shall be the ground to terminate the judge’s lifetime monthly allowance in connection with the retirement.
