The meeting of the High Council of Justice was attended by 13 members of the Council: H. Usyk, T. Bondarenko, O. Blazhivska, Yu. Bokova, S. Burlakov, O. Kovbii, A. Kotelevets, D. Lukianov, R. Maselko, I. Plakhtii, O. Popikova, V. Salikhov, O. Sasevych.
1. The High Council of Justice decided to leave without consideration the consent of the judge of the Leninskyi district court of the city of Mykolaiv KYRYLCHUK Oleh Ihorovych for secondment to the Popasnianskyi district court of the Luhansk region.
2. The High Council of Justice decided to dismiss VOLKOV Oleksandr Fedorovych from the position of the judge of the Supreme Court of Ukraine in connection with the submission of an application for resignation.
To establish that the right to accrual and payment of a lifetime monthly allowance shall arise from the next day after Volkov Oleksandr Fedorovych reaches the age of sixty-five.
3. The Hіgh Council of Justice decided to dismiss CHUMAK Tetiana Andriivna from the position of the judge of the Apostolivskyi district dourt of Dnipropetrovsk region in connection with the submission of an application for resignation.
4. The High Council of Justice decided to dismiss TKACHENKO Nina Hryhorivna from the position of the judge of the Supreme Court in connection with the submission of an application for resignation.
To establish that the right to accrual and payment of a lifetime monthly allowance shall arise from the next day after Tkachenko Nina Hryhorivna reaches the age of sixty-five.
5. The High Council of Justice decided to dismiss KAPKIN Oleksandr Borysovych from the position of the judge of the Zarichnyi district court of the city of Sumy at his own request.
6. The High Council of Justice decided to dismiss KRAVCHENKO Mykhailo Mykolaiovych from the position of the judge of the Odesa circuitt administrative court in the connection with the submission of an application for resignation.
7. The High Council of Justice decided to dismiss FEDOROVA Olena Vladyslavivna from the position of the judge of the Economic court of Zaporizhzhia region due to her resignation (in connection with the submission of an application for resignation).
8. The High Council of Justice decided to address to the Prosecutor General’s Office on providing information on disclosure and investigation of a crime in criminal proceeding No……, entered to the Unified Register of Pre-trial Investigations on January 17, 2023,, on the grounds of a criminal offense under part one of Art. 376 of the Criminal Code of Ukraine, based on the facts stated in the report of the judge of the Novozavodskyi district Court of the city Chernihiv KARAPUTA Olena Oleksandrivna.
9. The High Council of Justice postponed the consideration of the report of the judge of the Korsun-Shevchenkivskyi district court of Cherkasy region LITVINOVA Halyna Mykolaivna about interference in the judge's activities regarding the administration of justice.
10. The High Council of Justice decided to approve the advisory opinion regarding the draft Law of Ukraine “On making amendments to the Code of the Administrative Procedure of Ukraine, the Civil Procedure Code of Ukraine, the Economic Procedure Code of Ukraine and other legislative acts regarding the implementation of the judicial proceedings under the conditions of martial law or a state of emergency and the settlement of the disputes with the participation of a judge”, registration No. 8358, submitted to the Verkhovna Rada of Ukraine on January 13, 2023 for the consideration by People's Deputies of Ukraine Babii, R.V., Velmozhnyi, S.A., Razumkov, D.O., Dmytriieva, O.O., Saladukha, O.V., Yakovlieva, N.I, Novikov, M.M., Vatras, V.A., Fris, I.P., Bozhyk, V.I., Kalaur, I.R., Horobets, O.S., Mykyshа, D.S., Dyrdin, M.Ye., Frolov, P.V., Koval, O.V., taking into account the stated remarks (comments) and reservations (caveats).
An advisory opinion should be forwarded to the Verkhovna Rada of Ukraine.
11. The High Council of Justice decided to return the notice of necessity to consider the issue of secondment of the judges to the Popasnianskyi district court of Luhansk region to the State Judicial Administration of Ukraine.
12. The High Council of Justice decided to approve the redistribution of the state budget expenditures according to the economic classification codes of expenditures 2113 “Judicial remuneration” and 2120 “Accrual for the labor remuneration” in terms of the courts and the directorates of the State Judicial Administration of Ukraine in accordance with the appendix to the letter of the Head of the State Judicial Administration of Ukraine dated February 21, 2023, No. 11-2107/23.
A copy of the decision should be sent to the State Judicial Administration of Ukraine.
The High Council of Justice did not include the notice of the State Judicial Administration of Ukraine of necessity of the secondment of a judge to the Chutivskyi district court of Poltava region to the agenda of the meeting.
